Tuesday's move opens a public-comment period on the proposal before any final approval by the president.

The new plan, an advance copy of which was reviewed by The Wall Street Journal, recommends a menu of upgrades created to let coal-fired plants produce energy with less fuel and seeks to eliminate triggers that mandate costly technological overhauls at coal plants.

He said he believes the new rules by the Trump administration is a win for states because they will have the opportunity to regulate the industry within their own state.

"The fingerprints of the coal industry are all over this plan", Massachusetts Attorney General Maura Healey said in a statement.

The new proposed rule, which the EPA calls the "Affordable Clean Energy" rule, would eliminate Obama-era standards that would have required power plants to reduce carbon emissions either by converting from coal to cleaner sources of energy or by building carbon-capture technologies. The argument has not yet been tested in court, although opposition to the rule proposed today may give the administration a chance to try it out.

"When an agency wants to do something that's harmful to the American people, it typically tries to hide it", said Richard Revesz, director of the Institute for Policy Integrity at the New York University School of Law.

However, Bill Wehrum, assistant administrator for EPA's Office of Air and Radiation, said under the federal Clean Air Act, the agency can't control the entire electrical system.

Trump has vowed to end what Republicans call a "war on coal" waged by Obama.

In addition to giving states greater flexibility, the ACE rule would replace costly regulatory requirements which would increase electricity prices and cost jobs.
