The BJP may have wrestled its way to establish its government in Karnataka under the chief ministership of BS Yeddyurappa, but the CM's worries are far from over. Only then will a floor test be conducted.

The three judges concurred that the best way to resolve this would hold a floor test in the Karnataka Assembly. The Apex court will resume hearing on Karnataka political row at 10.30 AM today.

India's ruling Bharatiya Janata Party (BJP) leader and former Chief Minister of the southern state of Karnataka B.S. Yeddyurappa leaves to meet the state governor to stake claim to form the government, in Bengaluru, India, May 16, 2018.

The BJP won 104 seats in the 224-member assembly, nine short of a majority.

After a almost three-and-a-half-hour hearing beginning 2:11 AM, a three-judge apex court bench made it clear that the provisional swearing-in and the government formation would be subject to the final outcome of the case before it.

Karnataka Governor Vajubhai Vala calls special assembly at 11 am for oath-taking before the floor test at 4pm.

The Bench comprising Justices A K Sikri, S A Bobde and Ashok Bhushan was hearing the petitions filed by the congress and JD (S) party. The JD (S) and the Congress had moved the Supreme Court after governor Vajubhai Vala invited the BJP to form the government first, seeking a stay on the swearing-in, calling it unconstitutional.

His contention was rebutted in the top court by a lawyer representing the Congress-JD (S) combine, who said the Constitution was going to be "hanged" in the Karnataka case.

India's Prime Minister Narendra Modi has eked out a narrow, uncertain victory following a bitterly-fought state election in the south Indian state of Karnataka, with its minority government sworn in Thursday.

Amid a power struggle in Karnataka, some of the newly-elected JD (S) and Congress MLAs from the state arrived in the city today and are expected to be lodged in five-star hotels or resorts here, party sources said.

Having received the list of elected legislators from the Election Commission and having acknowledged the receipt of claims made by the BJP and the JDS-Congress alliance, the governor was duty-bound to invite JD (S) leader H.D. Kumaraswamy to form the government and prove his strength on the floor of the House. BJP President Amit Shah said that the people have rejected the negative politics of the Congress. However, a trust vote at the time of government formation requires majority of the strength of the house.

The election to one seat was countermanded after the death of a candidate. Congress and Janata Dal also claim to have the support of two independents and have accused the BJP of trying to bribe their members to switch sides. Indian television channels reported that Congress was planning to approach the Supreme Court late in the night to challenge the governor's decision.
