Police have released few details about the accident that occurred Sunday night in Tempe, Arizona, a suburb of Phoenix, while the vehicle was driving in autonomous mode. She was crossing midblock, and is shown beginning to turn her head toward the oncoming vehicle just as it closed in.
Exterior video showed the Uber auto driving at night when the vehicle's headlights suddenly illuminated Herzberg, who was walking her bike in the street, outside of any crosswalks.
Tempe Police Chief Sylvia Moir has said the accident may have been "unavoidable" and it appeared that Uber may not be at fault. The vehicular crimes unit is investigating, and the department anticipates "submitting the case for review to the Maricopa County Attorney's Office", according to a police statement.
