Miguna declines to take plea at Kajiado Court

It is not clears what law the government used to eject him from Kenya as the Constitution guarantees him citizenship since he is Kenyan by birth.

On Monday, Judge Kimaru issued orders requiring the lawyer to be personally produced in court by inspector general of police Joseph Boinnet and directorate of criminal investigations DCI boss George Kinoti.

Miguna was arrested on Friday in a dawn raid on his home.

The journalists -Linus Kaikai, Larry Madowo and Ken Mijungu- believe that police planned to arrest them and applied to the courts for anticipatory bail, was set at KSh10 0000 (US$983 or about R12 000) each. He was granted bail of 50,000 Kenyan shillings ($500) but has remained in police custody with his whereabouts unknown until he appeared in court in Kajiado County, neighbouring Nairobi, on Tuesday to hear the charges.

Miguna told a magistrate there that he can not take a plea in the court because "Justice Luka Kimaru is waiting for me at the Milimani Law courts in Nairobi".

Justice Kimaru had directed that police present him before court Wednesday at 11am.

The government ignored court orders to restore transmission for the stations and to release opposition activist Miguna Miguna.
